The prosecution stated that the project could promote environmental devastation and deforestation of vegetation in conservation areas.On Thursday, Juliana Mattei, a lawyer representing Icipar (the company in charge of the construction of the complex), stated that in the previous judgment, the decision to suspend the license did not mean that the project could not be allowed if it were reviewed.
"As a result of this decision, the Andaraguá Complex filed motions for clarification, with requests for attribution of infringing effects, that is, to revise the judgment, pointing out that the specific legislation applied to the area itself had not been observed, regarding its location. Environment protection rules apply to rural areas, and others to urban areas," he says.
According to the defender, the company pointed out to the Court that the percentages required for rural areas had been applied to the project when the location is registered as an urban area. "So, these were the legal reasons, in addition to several other issues that we raised to justify the review of the position of the interpretation given to the legislation by the Court of Justice", she says.
