The São Paulo City Council approved a series of measures on Tuesday (02) that will directly impact the zoning of the city of São Paulo, primarily the central regions, Faria Lima and transportation axes. A significant development is that the approvals will allow for taller buildings and new construction areas.
One of the main points of interest is the exploration of a new area in Faria Lima – a region near Juscelino Kubitschek avenue and Santa Justina street, practically the last 500 meters of the avenue.
Currently, this section has seven developments, all Class A+, of which only two have vacancies. The benefited area already has several projects for the construction of commercial assets. Additionally, the area has other developments, many residential, and a plot identified as owned by Partage.
The changes were made directly within the Faria Lima Urban Operation, which has been ongoing since the 1990s. This "mini-zoning" of the region will allow a new wave of auctions for Certificates of Additional Construction Potential (CEPACs), with a 45% increased value, enabling the legalization of irregular developments.
Ilmar Muniz, lawyer, director of Grupo CM, specialist in criminal, constitutional, and consumer law, says these changes will allow construction projects to resume, such as the controversial St. Barths building.
“Developments with embargo for not complying with the previous law can now, based on the new zoning law with this mini-review, apply to the municipalities for approval of the construction project according to current legal standards,” says Muniz.
Despite the name, the Faria Lima Urban Operation will also benefit a neighborhood almost 5 km away, Paraisópolis. According to the legislative president of the Council, Milton Leite (UNIÃO), R$ 3 million will be allocated for investments in the region.
“Urban Operations are the city's oldest urban planning laws. From the late 1990s to the early 2000s, we are revitalizing these laws to make them competitive with the rest of the city, allowing greater revenue generation and better and more homogeneous urban development in these regions,” said the proposal's rapporteur, councilor Rodrigo Goulart (PSD).
“The zoning law allows with this mini-review that places and axes where construction growth was not allowed now will be permitted, such as the Paraisópolis axis, which had a distortion prohibiting specific buildings and businesses on certain streets, such as the construction of schools,” comments Muniz.
Along with the "mini-review" zoning operations package, the conclusion of the Água Espraiada Consortiated Urban Operation was approved.
The measures that will come into effect will also include a series of incentives for the construction of taller buildings and road improvements. These measures will include a radius of 400 meters from the stations of CPTM Line 9–Emerald (Vila Olímpia, Berrini, Granja Julieta, and João Dias), and the stations of Line 5-Lilac and the future Line 17-Gold.
This operation benefited the regions of Vila Olímpia, Chucri Zaidan, Morumbi, Chácara Santo Antônio, Berrini, JK, and Pinheiros. This time, this review will mainly impact Av. Engenheiro Luís Carlos Berrini.
Other proposals were also voted on and approved. The Urban Intervention Project (PIU) Central Sector and PIU Jurubatuba Arc were approved. These plans will implement road improvements, infrastructure investments, creation of Social Interest Housing (HIS), and relocation of people in risk areas.
The PIU Central Sector will focus on the Liberdade neighborhood and the improvement of Esplanada da Liberdade. In this region, the height limit will be 28 meters, and there will be new commercial centers and architectural installations related to traditional Japanese culture.
The PIU Jurubatuba Arc will cover neighborhoods such as Santo Amaro, Vila Andrade, and Interlagos. The plan will create HIS and invest in infrastructure and public facilities. Additionally, minimum bike parking spaces in residential apartments were defined, and the creation of Floodplain Environmental Compartment areas, whose boundaries were unclear in previous legislation.
